How do I file a damage claim against the City of Lexington, NC?
If you feel the City may be responsible for personal injury or property damage, please contact the Risk Safety Manager to file a claim. Please be prepared to provide the following: date, time and place of the alleged loss, a brief description of the circumstances, and the names and numbers of any witnesses, if available.
What happens to a claim after it has been filed?
The Risk Manager will review the claim and any additional supporting documentation. After the claim is reviewed, you will be contacted via mail or phone by the Risk Manager. The City's policy and procedures only allow the approval of claims in which the City is negligent.
Is the City responsible for vehicle damage resulting from a pothole, manhole and/or other road hazards?
The City is not legally liable for damages in these types of cases. This type of incident is considered a road hazard in the State of North Carolina and the City is not liable, unless the City had prior knowledge of the pothole and/or any other hazard existing in the roadway and failed to correct that problem within a reasonable amount of time. This type of damage is usually covered under the collision coverage of your personal automobile policy.
