National Pollutant Discharge Elimination System (NPDES) Phase II

The City of Lexington is a federally-designated NPDES Phase II community and is currently managing a Stormwater Management Program. This program was designed to preserve, protect and improve the nation’s water resources from polluted stormwater runoff. The City received its Individual Stormwater Permit November 11, 2016 from the North Carolina Department of Environmental Quality Division of Energy, Mineral and Land Natural Resources (NCDEQ-DEMLR).

Post Construction Regulations & Requirements

A requirement of the Lexington permit was the adoption of post-construction stormwater regulations with the intent of managing stormwater runoff resulting from new development. The post-construction provisions are included in the stormwater control regulations located in Section 3.11 of Lexington's Unified Development Ordinance. The stormwater control regulations follow the N.C. Division of Energy, Mineral, and Land Natural Resources Stormwater Model Ordinance and the Best Management Practices (BMP)/Stormwater Control Measures (SCM) Design Manual, and became effective November 13, 2017, and apply to all new development and redevelopment of one acre or more.

Stormwater Program Operations

The stormwater program operates as a division of the Water Resources Department. Water Resources continues to coordinate management activities of multiple departments using both City resources and contract services. Existing City departments most involved include Engineering, Planning and Inspections, Water & Wastewater, and Public Works and Recycling and Waste Collection. The Street Department maintains responsibility for drainage and infrastructure located within the City’s transportation right-of-ways.
